1. Services Covered

I consent to receive diagnostic testing and related services (“Genics Physician Review Services”) provided by Genics Laboratories, LLC (“Genics,” “we,” “our,” or “us”) and its contracted independent physician groups, as applicable based on my state of residence.

Scope of Physician Review Services

These services may include:

• Physician review and approval of my test request(s);
• Review, interpretation, and authorization of my laboratory results (“Results”);
• Contact regarding abnormal, critical, or reportable Results;
• Optional telehealth consultations, counseling, or educational sessions (“Consults”); and
• Care coordination, referrals, or education where permitted by applicable law.

All medical decision-making, including approval of test orders and review of Results, is provided solely by the applicable contracted physician group (Nevada Health Services LLC or Meliora Medical Group Inc), acting as independent medical contractors.

The physician(s) providing services are not employees, agents, or partners of Genics Laboratories, and this agreement does not create a partnership or joint venture.

2. Acknowledgements and Agreements

I understand and agree that:

• I have reviewed and understand the information provided about the test(s) I am ordering.
• The information I provide is true, accurate, and complete.
• I authorize Genics Laboratories and the applicable physician group to share my health information for the purpose of providing the Genics Physician Review Services.
• Genics Physician Review Services do not replace care by my personal physician.
• If a Result is abnormal, critical, or requires prompt follow-up, the applicable physician group or the Genics Care Team may contact me by phone, secure message, or mail.
• I am responsible for responding to outreach attempts, sharing my Results with my own physician, and arranging any necessary follow-up care.
• Certain Results (including sexually transmitted infections and other reportable diseases) must be reported to public health authorities as required by law.
• I will not delay seeking medical advice based solely on my test Results.
• The physician or physician group providing services depends on my state of residence, and services are provided only by physicians licensed in the state in which I am located at the time services are rendered.
• If I am a California resident, I understand that Meliora Medical Group Inc is responsible for physician oversight and medical decision-making related to my test order, and I may contact them directly using the contact information provided.

3. Payment / Physician Service Fee

I understand that each test order requires physician review and authorization provided by Genics’ contracted independent physician group (Nevada Health Services LLC or Meliora Medical Group Inc, depending on my state of residence).

Genics Laboratories charges a flat $5 physician service fee for this review, which covers medical oversight and result authorization.
This fee is non-refundable once my order has been reviewed by the physician.

4. Telehealth Consent

If I participate in a telehealth Consult:

• The applicable physician group will determine whether telehealth is appropriate.
• Consults may occur via phone or video and will not be recorded.
• I may withdraw my consent to telehealth at any time by contacting [email protected].
• Technology-based encounters carry risks, including interruptions or data breaches.
• I may require in-person evaluation or treatment.

California Residents:
Telehealth services are provided in accordance with the California Telehealth Advancement Act and applicable provisions of the California Business and Professions Code. I may refuse or withdraw consent to telehealth at any time without affecting my access to laboratory testing services.

5. Alternative Options

I understand I may obtain testing through my own physician, urgent-care clinic, or other medical facility.
I voluntarily choose Genics Laboratories’ DTC testing.

6. Communications

I authorize Genics Laboratories and the applicable physician group to contact me via email, text, phone, or mail regarding my tests, Results, and follow-up care.
I will notify Genics Laboratories of any changes to my contact information.

7. Privacy

My health information will be handled according to the Genics Laboratories Notice of Privacy Practices, available upon request.
Genics Laboratories complies with HIPAA and applicable state privacy laws, including California privacy requirements where applicable.

8. Limitation of Liability

To the maximum extent allowed by law, neither Genics Laboratories nor its contracted physician groups or physicians shall be liable for any indirect, incidental, special, or consequential damages arising out of or related to the Genics Physician Review Services.
Total liability shall not exceed one hundred dollars ($100).

10. Consent

I have read this Informed Consent carefully, all my questions have been answered, and I voluntarily agree to proceed.

INFORMED CONSENT TO PERFORM HIV TESTING

(Applies only if you order an HIV test or an STD panel that includes HIV testing.)

I understand that:

• HIV attacks the immune system and, if untreated, can cause AIDS.
• The HIV test detects antibodies and/or viral material in my blood sample.
• Testing too soon after exposure may yield a false-negative result (“window period”).
• If I believe I was exposed within the last 72 hours, I should immediately contact a physician to discuss post-exposure prophylaxis (PEP).
• If my test is reactive, a licensed physician may contact me to discuss results, confirmatory testing, counseling, and treatment options.
• HIV testing is confidential but not anonymous and requires identifying information.
• Positive results are reported to the appropriate state health department as required by law.
• Discrimination based on HIV status is prohibited by law.

I hereby consent to be tested for HIV.

TERMS OF USE & NOTICE OF PRIVACY PRACTICES

A. Terms of Use

• Non-Emergency Use: Services are not for medical emergencies. Call 911 for emergencies.
• Eligibility: You must be 18 or older and in the United States when using the Services.
• Payment: DTC testing is self-pay only. No insurance, Medicare, or Medicaid billing.
• Physician Oversight: Provided by the applicable contracted physician group.
• Consult Scope: Limited to reviewing Results, education, and limited treatment where permitted by state law.
• Disclaimers: Services are provided “as is” without warranties.
• Indemnification: You agree to hold harmless Genics Laboratories and its contracted physician groups from claims arising from misuse of Services or Results.
