Welcome to geniclabs.com (the “Site”). The Site is owned and operated by My Genius Lab LLC (“Genics Laboratories”). Genics Laboratories enables individuals to select and purchase laboratory testing, products, and other services from Genics Laboratories and affiliated or non-affiliated third-party providers (collectively, the “Services”). By accessing or using the Site to purchase Services, you (“You” or “Your”) agree to be bound by these Terms and Conditions. If You do not accept these Terms and Conditions, You may not use the Site to purchase Services. References to “We,” “Us,” or “Our” mean Genics Laboratories.
ARBITRATION AND CLASS ACTION WAIVER: THESE TERMS CONTAIN AN AGREEMENT TO ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS. BY ACCEPTING THESE TERMS, YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION. PLEASE READ CAREFULLY.
These Terms and Conditions govern Your use of the Genics Laboratories website (“Site”) and any services provided through it (“Services”). By accessing or using the Site, You agree to comply with these Terms.
- Scope and Use of Services
The Site provides general information about Genics Laboratories, its diagnostic tests, data analysis, and health-related content. Some affiliated laboratories may be CLIA-certified and offer HIPAA-covered services; however, Genics Laboratories does not provide HIPAA-covered services directly. The Information on this Site is for educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider regarding medical conditions or before starting, stopping, or changing any treatment. In case of medical emergencies, call 911 immediately. Use of the Site is at Your own risk, and Genics Laboratories does not guarantee the accuracy or completeness of Information. Features and services may change without notice.
You must provide accurate and complete information, maintain current contact details, comply with all applicable laws, and be at least 18 years old (or use the Site under a legal guardian if under 18). You are responsible for securing your hardware, software, and internet connections. The Site may include content some users find offensive. Use of third-party services is at Your own risk.
- Intellectual Property
All content on the Site is protected by copyright, trademark, patent, or other applicable laws. You may access, download, or print content for personal, non-commercial, educational, or scientific purposes only. Any other use requires written permission. We may deny linking at our discretion. - Representations and Warranties
By using the Site, You represent that You are 18 years or older, voluntarily request Services, provide accurate information, and, if required, obtain approval from licensed medical providers according to state laws. Prescriptive providers will not approve requests for individuals under 18 or over 100 years old. Services are for personal use within the United States and not for resale or export. - Lab Tests and Communications
For applicable tests, results may be sent securely via email. By providing contact information, You acknowledge that electronic communications may be intercepted. If You provide a mobile number, You consent to receive transactional SMS messages regarding tests, results, accounts, or scheduling. Message frequency may vary; standard carrier rates may apply. Reply ‘STOP’ to unsubscribe or ‘HELP’ for assistance. SMS messages are not secure, and Genics Laboratories is not liable for delays or undelivered messages. - Privacy
Your information will be used as described in the Genics Laboratories Privacy Notice and applicable law. By agreeing to these Terms, You consent to the collection, use, and disclosure of Your information as outlined in the Privacy Notice, including communications regarding Services or events. - No Substitution for Medical Advice
Laboratory testing purchased from Genics Laboratories does not replace the interpretation, diagnosis, or care recommendations of Your healthcare provider. Test results are for informational purposes only and are not intended to diagnose, treat, or manage medical conditions. Results may vary based on age, medications, fasting, or other factors. False-positive and false-negative results are possible. You are responsible for discussing all results with Your healthcare provider. Certain conditions may not be detected by these tests alone. - Specimens and Alert Notifications
For tests requiring specimen submission, results will be reviewed by an authorized medical provider licensed in Your state. If results are significantly outside normal ranges, the provider may contact You (“Alert Calling”). By using our Services, You authorize this process and waive claims related to medically necessary Alert Calling. You should share results with Your personal healthcare provider. Additional testing or services requested by Your healthcare provider may incur extra costs. Any medical services provided by independent providers are subject to their own terms and privacy policies. Genics Laboratories is not responsible for the performance or non-performance of these services. Fees collected on behalf of providers are non-refundable. - Financial Responsibility
Purchasing Services means You have elected not to seek reimbursement from insurers, health plans, or government programs (e.g., Medicare, Medicaid). All Services purchased are Your sole financial responsibility. You may submit eligible expenses to HSA, FSA, HRA, or similar accounts—confirm eligibility with Your account administrator. - Cancellation and Refunds
For in-person specimen collection tests, You may cancel within 60 days of purchase. A non-refundable $20 administrative fee applies, and state taxes may be non-refundable. If the specimen is not collected within 60 days, the purchase will expire. Refunds, if any, will be issued minus the non-refundable fee to the original payment method. Purchases less than the non-refundable fee are non-refundable. Other Services may have additional terms described on specific product pages, and by purchasing, You agree to those terms. - Promo Codes
If using a sponsor-provided promo code, follow the sponsor’s program terms. Testing must be completed within the specified timeframe. Genics Laboratories will not share Your identity-linked results with the sponsor without Your consent. Non-sponsored testing costs remain Your responsibility, and canceled or expired testing may be subject to non-refundable fees. - Third-Party Services
Genics Laboratories may engage third-party organizations for Services or administrative support. These third parties may also subcontract services. Genics Laboratories is not responsible for the actions or performance of third-party organizations. - Privacy and Data Security
All personal information is handled according to Genics Laboratories’ Privacy Notice and applicable law. By using the Services, You consent to the collection, use, and disclosure of Your information as described. - SMS Communications
If You provide a mobile number, You consent to receive transactional SMS updates regarding Your tests, results, account, and scheduling. Message and data rates may apply. Reply ‘STOP’ to unsubscribe or ‘HELP’ for assistance. SMS messages are not encrypted, and Genics Laboratories is not liable for delayed or undelivered messages. - Reporting of Test Results. Clinical labs and healthcare providers may report Your results to local, state, or federal authorities as required by law or as You authorize.
- No Rights Granted. You have no rights to use the name “Genics Laboratories” or suggest any affiliation or sponsorship with us.
- Changes to Terms. Genics Laboratories may update these Terms at any time. Changes take effect upon posting online and do not apply retroactively to prior claims.
- Disclaimer of Warranty. Services are provided “as is” without warranties. Genics Laboratories disclaims all express or implied warranties, including merchantability or fitness for a particular purpose. Third-party products or services referenced on our site are not guaranteed by us. Where disclaimers are limited by law, liability will be limited to the maximum extent allowed.
- Assumption of Risk. By using our services, You acknowledge and accept all associated risks, including third-party review of testing and laboratory processing.
- Indemnification. You agree to defend, indemnify, and hold harmless Genics Laboratories, its affiliates, and representatives from any claims, losses, or expenses arising from Your use or misuse of the services or violation of these Terms.
- Limitation of Liability. Genics Laboratories, its officers, employees, and affiliates are not liable for indirect, incidental, special, or punitive damages. Our total liability for any claim will not exceed the amount You paid for the services. Some jurisdictions may not allow certain exclusions, in which case liability is limited to the maximum extent allowed by law.
- Binding Individual Arbitration; No Class Actions
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. THERE IS NO JUDGE OR JURY IN ARBITRATION, AND DISCOVERY PROCEDURES AND APPELLATE RIGHTS ARE MORE LIMITED THAN IN COURT.
- Disputes that Must Be Arbitrated. This agreement applies to any “Dispute” between You and My Genius Lab LLC (“Company”). “Dispute” means any dispute, claim, or controversy (excluding the exceptions listed below) between You and Company, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, for which either party seeks legal recourse, including the validity, enforceability, or scope of this agreement to arbitrate or any portion of it.
The exceptions to this arbitration requirement are:
(i) claims that can be brought as individual actions in small-claims court;
(ii) pursuit of enforcement actions through a government agency if allowed by law;
(iii) actions to compel or uphold any prior arbitration decision;
(iv) Your or Company’s right to seek injunctive relief in court to preserve the status quo while arbitration proceeds;
(v) claims of intellectual property infringement;
(vi) claims that are the subject of a proposed class or collective action settlement in any court;
(vii) the enforceability of the requirement that arbitrations must be conducted individually rather than as a class; and
(viii) certain roles expressly specified for courts in the terms below.
- Informal Resolution. If You have a Dispute with Company or vice versa, the parties will attempt to resolve the matter informally before initiating arbitration to save time and costs. The parties will engage in good-faith negotiation for at least 30 days after written notice of the dispute (“Notice of Dispute”) is received.

Company will also send any Notice of Dispute to Your registered email address and any address You provided. Notices must include sender’s contact info, a description of the dispute, and requested resolution. Arbitration cannot proceed until compliant notice is given.
- Small-Claims Court. Notwithstanding arbitration obligations, disputes that qualify for small-claims court in Your county of residence or in Clark County, Nevada, may be brought individually in such court. Informal resolution is encouraged but not required before filing in small-claims court.
- Binding Individual Arbitration. Arbitration will be on an individual basis only. Company does not consent to class arbitrations.
Disputes will be settled by binding individual arbitration under the AAA Consumer Arbitration Rules and the Federal Arbitration Act (FAA). Arbitration replaces court proceedings with a neutral arbitrator instead of a judge or jury.
“Individual” means relief is limited to the individual parties involved; “Binding” means both parties must comply with the arbitrator’s decision, subject to FAA-limited appeals. Arbitrators may grant temporary, interim, or permanent injunctive relief necessary to resolve individual claims.
- Arbitration Procedure and Location. Arbitration is initiated by filing a Demand for Arbitration with AAA: https://www.adr.org/consumer. Copies of the demand must be sent to:

Arbitration will be conducted in Clark County, Nevada or another Nevada location if an in-person hearing is required. Smaller claims (<$10,000) may be decided on written submissions; larger claims may involve hearings via video, telephone, or in-person as needed.
- Consumer Arbitration Fees. If You initiate arbitration, You pay the filing fee, which Company may cover for claims ≤$5,000. For larger claims, Company may assist if arbitration costs would be prohibitive. Company pays its own fees if it initiates arbitration. Attorneys’ fees are separate unless law provides otherwise.
- Notice and Filing Deadlines. Arbitration must be commenced within two years of the dispute arising (or sooner if required by law).
- Coordinated Filings. Multiple similar disputes may be handled as “Coordinated Cases” with bellwether trials to test claims. Mediation may follow to attempt global resolution before remaining cases proceed in court.
- Continuation in Effect. This dispute resolution section survives any termination of other agreements between You and Company.
- Future Terms Changes. Company cannot modify these arbitration terms to make them less favorable once a dispute arises.
- Class Action Waiver. All disputes must be pursued individually. Class, collective, or representative actions are prohibited except for limited exceptions related to Coordinated Cases.
- Severability. If any provision is invalid, unenforceable, or illegal, it is severed, and the rest remains in effect. If the class-arbitration prohibition is invalid, arbitration agreement is void, and disputes will be resolved in Nevada courts.
- Your 30-Day Right to Opt-Out. You may opt out of binding arbitration (excluding class waiver) by sending written notice within 30 days of acceptance to:

- Equitable Relief
A breach or threatened breach of these Terms would cause irreparable harm for which monetary damages are inadequate. The injured party may seek equitable relief, including injunctions, temporary restraining orders, or specific performance, in addition to other legal remedies.
- Force Majeure
Neither You nor Company is liable for delays or failure to perform due to causes beyond reasonable control, including natural disasters, acts of government, health emergencies, strikes, cyberattacks, or similar events (“Force Majeure Event”).
